The Standard (Lykens, Pennsylvania), 31 Aug 1928, Fri, Page 1.6 - Her estate was probated in December 1928; A dispute arose among Idas's children over her estate. Apparently, before she died Ida deeded a lot in Wiconisco Township to her daughter Lizzie Cox, with whom she lived. Harry, Edward, Tillie, and Clarence, filed an injunction proceeding to overturn that deed and have the lot returned to the estate on grounds of fraud and undue influence, claiming that Ida "was mentally incompetent to transact business." (The Standard (Lykens, Pennsylvania), 21 Dec 1928, Fri, Page 9.) From the available newspaper accounts it is not clear when or how this dispute was resolved, although in December, 1929, a year later, the suit was refiled by Edward, Harry, Clarence, and Harvey Schreffler.7,8,9

Daniel Merkel Wiest
M, #15323, b. 7 March 1822, d. 16 September 1901
- Last Edited: 6 Mar 2017

- DANIEL MERKEL WIEST, son of JOHANNES and KATHARINA (MERKEL) WIEST, was born in Klingerstown, Schuylkill Co., PA, on March 7, 1822. Daniel married four times, fathering 26 children.
Daniel Merkel Wiest first married ANNA JULIANA "Angelina" KLINGER, daughter of JOHANN GEORG E and ELIZABETH (STEIN) KLINGER of Lykens, Dauphin Co., PA. Daniel and Angelina had ten children: an unnamed, stillborn infant son; DANIEL Jr., who died as an infant; FRANTZ KLINGER; HEIRAM KLINGER, who died in Libby Prison during the Civil War; ALBERT KLINGER; JULIANNA, who married William Dubendorf; RITSCHART KLINGER, SHERTEL KLINGER, and FELIX KLINGER WIEST.
Eight days after the birth of their tenth child, Angelina died. Daniel "farmed out" his four youngest surviving children to be raised by relatives, married second SARAH RICHERT, and headed "west" with the other members of his family. Daniel and Sarah had five children: JEFFERSON, LUSIANNA, CATHARINE, DAVID, and a daughter who later married and made her home in Williamstown, Dauphin Co., PA.
Daniel operated a brewery and tavern in Breckenridge, MO, for a number ofyears, during his "western stay." Family tradition holds that during this time he became well acquainted with J esse James and William Quantrell, leader of the notorious Quantrell's Raiders.
For some reason (perhaps because Sarah died), Daniel returned to Pennsylvania and married third EMI TROUTMAN, daughter of DAVID TROUTMAN. Daniel and Emi had six children: OSCAR, CHARLES , WILLIAM, TOBIAS, ELIZABETH, and HENRY. (In keeping with the family tradition, all five of their sons were given their mother's maiden name as their middle name.) Daniel and his new bride returned to Missouri, where the began his third family.
Here, the strangest episode in his life occurred. The following narrative appears in "The History of Caldwell and Livingston Counties,Missouri," published by the National Historical Co., St. Louis, MO, 1886 (pp 230-231).
A photocopy of the original account was sent to me [Bruce Hall] by Robin Lesher, 101 Harrisburg Pike, Dillsburg, PA 17019along with a photocopy of a plat map, dated 1876, showing Daniel M. Wiest's property located immediately north of the town of Breckinridge. Danie l Merkel Wiest was the son of Johannes and Catharina (Merkel) Wiest. His (third) wife was Emi "Emma" Troutman, daughter of David Troutman..

THE BRECKINRIDGE TRAGEDY -- KILLING OF JAMES B. ROGERS BY DANIEL M. WIEST
No tragic incident ever created more of a sensation in the county than did the shooting of James B. Rogers by Daniel M. Wiest, at Breckinridge, on the night of May 14, 1875. Mr. Rogers was a young unmarried man, andt the time was a clerk and salesman in a dry goods store. Danie l M.Wiest was an old man, 62 years of age, and lived and owned a brewery about three-fourths of a mile north of town. He had come from Pennsylvania to this county some years before. His wife Emma, bore a bad reputation for chastity, of which Wiest seemed to be aware. Living in Wiest's household was another man, a German, named E. Wilhelm.
On the night of the tragedy, at about 11 p.m., Mr. Rogers and another man, whose name was never disclosed, started out to Wiest's house for purposes best known to themselves. It is said that they went on an invitation. As they neared the house they were fired upon by some one, presumably Wiest, who was in ambush, and Rogers was mortally wounded. He was shot in both wrists (or in one hand and one wrist), through the knee, and in the abdomen. He died in 48 hours. Before he died, he gave the following particulars relating to the shooting:
"I was shot about 20 steps south of Wiest's house, near a gap that goes into the yard. Wiest was lying in ambush. I did not see Wiest until after he shot me. After I was shot, He (Wiest) walked around me. I suppose he was about 30 feet from me. As he passed around me I tol d him that he had shot me, and he must come and help me up, but he did not speak to me. I think he had his gun by his side. I crawled up to the house to get some water, and tried to get some one to go for a doctor, but they would not let me in. I then crawled about one-fourth o f a mile and got to the fence not far from Mr. Gallagher's. I know that Wiest shot me."

May 15, 1875*
Wiest was arrested the same night and had a preliminary examination before Esq. J. A. Halstead , who committed him to jail. He was afterward indicted and tried October 28, 1875, when he was convicted of murder in the second degree. A new trial was granted because while they were deliberating certain members of the jury had and used whisky in the jury-room. At the February term, 1876, of the circuit court he was tried again, and the jury returned a verdict of "not guilty." Soon afterwards, Wiest returned to Pennsylvania.
Pending the trial of Wiest, the German, Wilhelm, committed suicide by hanging himself.
The identity of the man who was with Rogers the night of the murder has, as stated, never been determined. Rogers kept the secret to the last. He said that no good could come of revealing it, but much harm might result, and so it was buried with him.
* Date of Rogers' statement erroneously transcribed as May 15, 1885.
